Privacy Policy

Objectives of the policy:
Luxembourg Business Angel Network (“LBAN”) is committed to safeguarding the privacy of visitors to its Site  www.lban.lu  (the “Site”). The purpose of the Site is to provide information on its creation, its activities, and news about the services provided by LBAN including its latest products and achievements to the users ("Users" / "you"). This privacy policy (the “Privacy Policy”) sets out the terms and conditions of use on which LBAN acting as data controller processes personal data collected from You or that You provide to us.

By using the Site, you acknowledge that you have duly read and understood the present Privacy Policy. You agree to such processing and you warrant that all data provided by you is accurate.

1. Personal data collected by LBAN

When, for which purpose and legal basis?

A. In the context of the consultation of the Site, you are not required to provide any personal information on the public areas of the Site.

B. As part of the initial contact relationship with you, you may choose to disclose voluntary personal data by completing the application forms on various sections of the Site.

It would be the case when providing personal data relating to you:

I. In the contact form so that LBAN can answer messages that you send us through the contact form (first name, last name, email address, etc)
This processing is based on article 6 (1) (a) of the General Data Protection Regulation (the “GDPR”) which is a freely given consent and on information provided voluntarily by you. This processing also comes under the legitimate interest, based on article 6 (1) (f) of the GDPR, of LBAN to give you the possibility of contacting LBAN and answering your questions;

II. In the application form (the “Membership Application”) when applying to become a member of LBAN (first name, last name, email address, IBAN, etc) based on Article 6 (1) (b) of the GDPR in order to perform the contract between the member and LBAN. This membership provides you with access to content (either through the download of materials or by enabling you to access the section of the part of the Site dedicated to members). In practice, this could be research, information and commercial materials selected by LBAN.

C. When subscribing to the LBAN's newsletter / mailing list as part of newsletters / mailing lists / other advertising, LBAN can only collect the contact details (first name, last name, email address) that you voluntarily provide. This processing is based on the free, specific, informed and unambiguous consent given by you, based on article 6 (1) (a) of the GDPR.

Please note that you have the option to opt out of receiving marketing email(s) by contacting info@lban.lu or by clicking on the unsubscribe link in the corresponding email. 

LBAN ensures that it collects and processes personal data that is relevant, adequate, non-excessive and strictly necessary to achieve the purposes that would be determined.

In the case of processing based on your consent, consent may be revoked at any time by you. Therefore, the processing of personal data based on the your consent may no longer be carried out in the future, without prejudice to the lawfulness of the processing that was carried out on the basis of such consent prior to the time of its revocation.

D. Recipients and transfer

As the case may be, LBAN will only disclose your information to third parties (potentially partners, members), outside the European Union (“EU”), where you have agreed to give your consent or where LBAN is required to do so by law or where it is necessary for the purpose of, or in connection with legal proceedings or in order to exercise or defend LBAN’s legal rights and, as the case may be, those of its partners and members.
If any data transfer involves countries which do not ensure an adequate level of protection, LBAN will implement adequate measures in compliance with the standards in force.

E. Data retention

We process personal data only for so long as is necessary for the purpose(s) for which it was originally collected and in relation with the legal retention periods.
LBAN can nevertheless keep the personal data for a longer period in order to comply with legal proceedings and the period of limitation.

F. Cookies

LBAN uses two types of cookies on the Site:
Strictly necessary cookies
Some of the cookies on the Site are essential in order to enable you to move around the Site and use its features.

Performance cookies
Some of the cookies on the Site collect information about how visitors use the Site, for example by logging which pages visitors go to most often.
When accessing the Site, users are directed to accept, decline or modify the cookie settings.

G. Security

LBAN uses up-to-date data storage and security techniques to protect the User’s personal data from unauthorized access, improper use or disclosure, unauthorized modification or unlawful destruction or accidental loss. All LBAN employees and any third parties it engages to process your personal data are obliged to respect the confidentiality of your data.

H. Your rights

You have the right to access the personal data LBAN holds about you,
You have the right to obtain any corrected inaccurate information about you,
You have the right to ask for the deletion of your personal data, depending on the legal retention periods,
You have the right to ask the restriction of the processing of your personal data,
You have the right to object at any time, for reasons relating to a particular situation, to the processing of personal data when said processing is based on the legitimate interests of LBAN. LBAN may, however, invoke legitimate and compelling reasons requiring the continuation of the processing,
You have the right to receive personal data provided to LBAN, in a readable format, the right to transmit this data to another data controller with any obstacles by LBAN.

When personal data is processed for direct marketing purposes, the right to object to the processing of personal data at any time.

If you have a complaint about any processing of your personal data being conducted by us, you can contact LBAN at info@lban.lu or lodge a formal complaint with the Commission Nationale pour la Protection des Données (“CNPD”), 15 Boulevard du Jazz L-4370 Esch-sur-Alzette Grand-Duché de Luxembourg

The processing of personal data in the framework of this Site is done by LBAN, having its registered office at 7 rue Alcide Gasperi L-2981 Luxembourg, being the data controller. In case of any question related to data protection at LBAN, please email info@lban.lu.

J. Changes to this Privacy Policy

The Privacy Policy may be amended from time to time as its sole discretion, including in the event of changes to data processing procedures or amendments to applicable laws. The Privacy Policy, as modified, will automatically apply to the Site.

k. Applicable law and competent jurisdiction

The present Privacy Policy shall be governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg and any disputes or claims arising out of or in connection therewith shall be brought exclusively before the courts of Luxembourg.
